Clean Electricity Production Credit (Section 45Y)

Federal production tax credit under IRC Section 45Y (technology-neutral successor to legacy Section 45 PTC). Pays per-kWh produced over 10 years. Same OBBBA binary cliff for wind/solar as 48E (NOT a gradual 60%/20%/0% phase-down — 30%/equivalent value preserved on the BOC-by-July-4-2026 OR PIS-by-Dec-31-2027 paths). Generally not preferred over 48E for distributed commercial solar (capex-heavy + small generation = ITC wins). May be relevant for community solar or large utility-scale developers in evlv.energy partnership pipeline.

- Owners of qualified clean electricity facilities placed in service after 12/31/2024 selling power into the grid (or self-consuming with valid metering). Election made annually between 45Y (PTC, 10 yr stream) and 48E (ITC, one-time). Direct pay + transferability available. BOC test per IRS Notice 2025-42: Physical Work Test (any size) or 5% Safe Harbor (solar ≤1.5 MWac only).

- Up to ~$0.030/kWh (2026, with prevailing wage + apprenticeship); base rate ~$0.006/kWh without PWA. Bonus adders (energy community, domestic content) stack on top. 10-year credit period from facility placed-in-service date. For wind/solar: BINARY CLIFF (same as 48E) — full value preserved if BOC by July 4, 2026 (4-year continuity safe harbor → PIS by Dec 31, 2030 for 2026 starts) OR PIS by Dec 31, 2027. Other clean tech retains prior IRA schedule.

- For evlv.energy use: rarely the right election for typical commercial solar customer. Default solar calculator shows ITC (48E). Surface 45Y only when query mentions "PTC", "community solar", "utility-scale", or annual generation > 1 MW.
